Terms of Service

Effective Date: March 7, 2026

1. Acceptance of Terms

By booking a session, purchasing a digital product, creating a SeshBot® account, using our websites (including saltysesh.co, seshbot.co, and app.seshbot.co), or interacting with SeshBot®, you agree to these Terms of Service. SeshBot® is a product and registered trademark of SaltySesh LLC.

2. Booking & Photography Services

Photography services are subject to availability and confirmation. All sessions require a non-refundable retainer or booking fee to secure your date and time.

Cancellations & rescheduling:

• Cancellations made more than 48 hours before the session: you may reschedule to a new date (subject to availability) at no additional cost. Retainers are non-refundable but may be applied to the rescheduled session
• Cancellations made within 48 hours of the session: the retainer is forfeited and no reschedule is guaranteed. We may, at our discretion, offer a reschedule on a case-by-case basis
• No-shows: if you do not show up and did not notify us, the retainer is forfeited and any remaining balance may still be due
• Cancellations by SaltySesh®: if we need to cancel or reschedule due to weather, illness, or emergency, we will reschedule at no cost or issue a full refund of all fees paid

Full refund and credit terms are outlined in our Refund Policy. Scheduling tools (including Calendly, if used) are optional and governed by their respective terms.

Gallery links and downloadable photos are made available for a minimum of 90 days after delivery. Clients are responsible for downloading all images within this window. After 90 days, files may be archived or removed. We are not responsible for undownloaded files after the gallery access period ends.

3. SeshBot® Subscription & Billing

SeshBot® is a paid subscription service available in multiple tiers. By subscribing, you agree to the following:

• Subscriptions are billed monthly at the rate displayed at the time of signup (currently $19/mo for Starter, $39/mo for Essential, and $79/mo for Pro)
• New accounts include a 30-day trial period. You will not be charged until the trial ends and your dedicated SMS number is provisioned and live
• After the trial period, your payment method will be charged automatically each month until you cancel
• You may cancel your subscription at any time by contacting us at hello@saltysesh.co. We require 30 days' notice for cancellation. Cancellation takes effect at the end of the current billing period following the 30-day notice window. No prorated refunds are issued for partial months
• If you cancel during the 30-day trial, you will not be charged regardless of the notice period
• SeshBot® is in early access. Pricing is subject to change as new features are added. Existing subscribers will be given advance notice of any price increases

All payments are processed by Stripe. Your payment information is collected and handled directly by Stripe and is never stored on our servers. Stripe's terms and privacy policy are available at stripe.com/legal.

4. SeshBot® Account Terms

When you create a SeshBot® account, you agree to the following:

• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account
• You must provide accurate and complete registration information and keep it up to date
• Each subscription is intended for use by a single photography business. Sharing account access or reselling the service to third parties is not permitted
• You must be at least 18 years of age to create an account
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or remain inactive for an extended period

5. Acceptable Use of SeshBot®

SeshBot® is designed for professional photographers to automate legitimate client communication. You agree not to:

• Use SeshBot® to send unsolicited messages, spam, or bulk marketing to people who have not consented to receive messages from your business
• Use the platform for any purpose other than photography-related client communication
• Attempt to reverse-engineer, scrape, copy, or extract the AI models, algorithms, or proprietary logic behind SeshBot®
• Circumvent or attempt to bypass usage limits, rate limits, or feature restrictions associated with your plan
• Use SeshBot® to send messages that are abusive, threatening, discriminatory, or illegal
• Resell, sublicense, or provide access to SeshBot® to third parties
• Interfere with or disrupt the platform's infrastructure or other users' access

We reserve the right to suspend or terminate any account that violates this acceptable use policy, with or without notice.

6. Termination, Suspension & Monitoring

We reserve the right to suspend, restrict, or permanently terminate any SeshBot® account at any time, with or without cause, and with or without notice. This includes but is not limited to accounts that:

• Violate these Terms of Service or any applicable law
• Engage in abusive, fraudulent, or harmful activity
• Send spam, unsolicited messages, or messages without proper client consent
• Exceed plan limits or attempt to circumvent restrictions
• Remain inactive for an extended period
• Pose a risk to the platform, other users, or our third-party providers

We may monitor account activity, message volume, and usage patterns to ensure compliance with these Terms, protect the integrity of the platform, and maintain service quality for all users. Monitoring is conducted for operational and security purposes only — we do not read the content of individual messages unless required to investigate a specific complaint or legal obligation.

If your account is terminated for cause, you will not be entitled to a refund for the current billing period. If we terminate your account without cause, we will provide a prorated refund for the unused portion of the current billing period.

Upon termination, your access to SeshBot® will be revoked immediately. Your data will be retained for up to 90 days per our data retention policy (see Privacy Policy), after which it may be permanently deleted. You may request a data export prior to termination.

7. SMS Messaging Terms & Subscriber Responsibility

By providing your phone number, you consent to receive transactional and service-related SMS messages, including confirmations, reminders, and optional SeshBot® interactions. Consent is not a condition of purchase.

Message and data rates may apply. Reply STOP to opt out at any time. Message frequency varies based on session activity. For support, reply HELP or contact hello@saltysesh.co.

For SeshBot® subscribers (photographers):

As a SeshBot® subscriber, you are responsible for ensuring that you have obtained proper consent from your clients before adding them to the platform and sending them SMS messages. You represent and warrant that each client whose phone number you add to SeshBot® has given you permission to contact them via text message on behalf of your business.

You agree to comply with all applicable laws and regulations governing SMS communications, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and any state-level equivalents. SaltySesh LLC is not responsible for messages sent by subscribers to clients who have not provided consent.

SMS number provisioning requires carrier registration, which may take 2–4 weeks after signup. Message delivery is subject to carrier filtering and may not be guaranteed in all cases.

8. SeshBot® & AI Disclaimer

SeshBot® uses AI to automate reminders, prep guidance, FAQs, and workflow communication. AI systems are probabilistic and may generate inaccurate or unexpected outputs.

SeshBot® is not a substitute for professional advice (legal, medical, financial, or otherwise). Users are responsible for reviewing important information before acting on it. We strongly recommend using the draft approval feature to review AI-generated messages before they are sent to clients.

9. Intellectual Property

SaltySesh LLC retains copyright to all photography, branding, written content, website materials, software, AI models, and SeshBot® assets unless otherwise agreed in writing.

Photography: model release & usage rights

By booking and participating in a photography session with SaltySesh®, you grant SaltySesh LLC a perpetual, non-exclusive, royalty-free license to use, reproduce, and display the resulting photographs for portfolio, marketing, social media, website, print, and promotional purposes. This includes but is not limited to: our website, Instagram, TikTok, Pinterest, blog posts, advertising materials, and industry submissions.

If you prefer not to have your images used for marketing purposes, you must notify us in writing (email is fine) before or within 7 days of your session. We will honor reasonable opt-out requests, though images already published prior to receiving your request may remain in circulation.

Photography clients may:

• Download and share delivered galleries for personal use
• Print images for personal use
• Post images online with reasonable credit to SaltySesh®

Photography clients may not:

• Sell, license, or sublicense images to third parties
• Use images for commercial advertising without written permission
• Alter, crop, or apply filters to images in ways that misrepresent our work (including heavy re-editing of final deliverables)
• Remove watermarks or metadata from images
• Enter images into contests or submit them for publication without permission

SeshBot® subscribers may not:

• Copy, reproduce, or redistribute any part of the SeshBot® platform
• Reverse-engineer or attempt to extract the underlying AI or source code
• Use SeshBot® branding, logos, or assets without written permission

10. Trademarks

SaltySesh® and SeshBot® are registered trademarks of SaltySesh LLC. All rights reserved. The SaltySesh® and SeshBot® names, logos, taglines, and associated branding are the exclusive property of SaltySesh LLC and are protected under federal trademark law.

You may not use, reproduce, display, or distribute the SaltySesh® or SeshBot® trademarks (or any confusingly similar marks) without prior written permission from SaltySesh LLC. This includes but is not limited to:

• Using our trademarks in your business name, product name, domain name, or social media handle
• Creating derivative works or logos that incorporate our marks
• Implying endorsement, sponsorship, or affiliation with SaltySesh LLC without authorization
• Using our marks in any way that is misleading, defamatory, or likely to cause confusion

SeshBot® subscribers may reference SeshBot® by name when describing the service to their own clients (e.g., "Powered by SeshBot®"), provided the reference is truthful and not misleading. Any other use of our trademarks requires written permission.

11. Indemnification

You agree to indemnify, defend, and hold harmless SaltySesh LLC, its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: your use of SeshBot® or any SaltySesh® service; your violation of these Terms; your violation of any applicable law or regulation (including TCPA and other SMS/telecom laws); any SMS messages you send through the platform; or any dispute between you and your clients.

12. Client Conduct

We reserve the right to decline or discontinue services due to unsafe conditions, harassment, abuse, or violations of these Terms.

13. Digital Products

Digital products (presets, templates, guides) are licensed for personal or business use, not resale. All digital sales are final except in cases of duplicate purchase or technical failure.

14. Service Availability

We strive for reliable service but do not guarantee uninterrupted access. SeshBot® depends on third-party infrastructure including SMS carriers, AI providers, and hosting services. Features, integrations, or automated tools may change or be discontinued at any time. We will make reasonable efforts to notify active subscribers of significant changes.

SeshBot® is provided "as is" and "as available." We do not warrant that the service will be error-free, that messages will always be delivered, or that AI-generated responses will always be accurate.

15. Limitation of Liability

To the fullest extent permitted by law, SaltySesh LLC is not liable for indirect, incidental, special, or consequential damages, including but not limited to: data loss, missed or undelivered messages, AI-generated inaccuracies, lost revenue, lost clients, or business interruption, regardless of the theory of liability.

For photography services, we are not liable for circumstances beyond our reasonable control, including but not limited to: equipment malfunction, memory card failure, extreme weather, venue restrictions, or unforeseen events that prevent us from completing a session as planned. In the unlikely event of a total loss of images due to equipment failure, our liability is limited to a refund of the session fee paid.

We are not responsible for photos that are not downloaded within the gallery access period (minimum 90 days after delivery). Clients are solely responsible for backing up their delivered images.

Our total aggregate liability for any claim arising out of or related to these Terms or your use of SeshBot® shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Arizona.

17. Updates

We may update these Terms periodically. Changes will be reflected by an updated effective date at the top of this page. If we make material changes, we will notify active SeshBot® subscribers by email. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
